Booking Terms and Conditions

The submission of the booking request form shall be deemed to constitute the acceptance of these Booking Terms and Conditions and Payment Procedures, by the Client and shall be an undertaking that he has the authority to act for and on behalf of the persons named on the Booking Request Form, including any substitutes or additions by any subsequent agreed amendments to the booking and contract for the travel and tour services. For purposes of these Booking Terms and Conditions, “Client” shall mean the named persons in the Booking Request Form including any substitutes persons and additional persons named therein or any one of them as the case may be and “this Agreement” means the Booking Request Form, these Booking Terms and Conditions as amended from time to time and all forms signed by the Clients and all of Travelex Travels and Tours L.L.C (“Travelex”) standard terms & conditions governing the travel and tour services.

 

FORMS OF PAYMENT ACCEPTED

The prices are quoted in AED (United Arab Emirates currency) (unless otherwise specified).

 

RESERVATIONS DEPOSIT & FINAL PAYMENT TERMS

A deposit may be required upon booking. The deposit forms part of your final payment. However, a payment of deposit does not constitute the confirmation of booking. Full payment is required upon confirmation of booking or 45 days before departure, whichever come first. Failure to comply with this may result in an automatic cancellation of your reservation and forfeiture deposit.

 

PRICE GUARANTEE

The price is fixed when the booking has been confirmed, the price has been fully paid and the acknowledgement / receipt thereof has been issued.

 

NOT INCLUDED IN LAND PRICE

Items not included in the price are generally described in the itinerary and include without limitation: airport taxes of any nature, both domestic and international; excess baggage charges as imposed by airlines; forwarding of baggage and purchases; cost of obtaining passport and visa; camera charges; emergency evacuation charges, medical charges for inoculations; any item of a personal nature for example, medicine laundry, postage, beverages, photography charges and other personal effects and belongings like clothing, camera; meals not included in itinerary and telephone/cable/fax/internet charges; baggage, trip cancellation and personal insurance; souvenirs and gratuities to or tips for tour guides escorts and drivers.

 

CANCELLATION PENALTIES & REFUND POLICY

If it becomes necessary to cancel your booking, you must notify Travelex Travels and Tours L.L.C immediately in writing. Once we receive your notice, cancellation will take effect. Full refunds without interest will be made less the applicable cancellation penalties in the following manner:

35 days or more before date of departure – Non-refundable deposit forfeited
21 – 34 days prior to departure – 35% of total tour price
14 – 20 days prior to departure – 50% of total tour price
07 – 13 days prior to departure – 75% of total tour price
Less than 7 days prior to departure – 100% of tour price

Any amendment to booking 30 days prior to departure shall be considered as a cancellation and will be levied with the applicable cancellation fees accordingly.

The Client shall be responsible for all expenses incurred by Travelex Travels and Tours L.L.C. or its agents in respect of making the bookings and canceling it.Travelex Travels and Tours L.L.C. or its agent will repay the customer any monies held by them in excess of the Non-refundable deposit after deducting the cancellation fees and any other expenses and payments.

Cancellations on air arrangements will be subject to penalties as imposed by the carrier. The Booking Request Form and Booking terms and Conditions are issued by Travelex Travels and Tours L.L.C. and not issued by or on behalf of, they any airline or agent whose services are used or proposed to be used in the course of the tour and does not bind such airline or agent to any obligations hereunder. All tours, services, and transportation are furnished by contractors that are independent of and that do not act for or on behalf of the Travelex Travels and Tours L.L.C., nor are servants of the same, and neither do they have any business relationship, or are in any joint ventures or otherwise.

Refunds will not be made whatsoever, for any unused tour services including but not limited to accommodations, meals, internal flights or sightseeing. Any other refund claims must be made in writing to Travelex Travels and Tours L.L.C. within 30 days of tour termination. Travelex Travels and Tours L.L.C. cannot accept any liability for claims received after 30 days of tour termination.

 

DELAY, CANCELLATION, ALTERATIONS AND ACCEPTANCE

Travelex Travels and Tours L.L.C. reserves the right to cancel any tour prior to departure including, but not limited to by reason of the number of people booking on any tour not having reached the minimum number quota of tour participants set by Travelex Travels and Tours L.L.C.,) in which case participants will be given a refund in full without interest. However you will not be entitled to make any further claim for any injury, loss, expenses or damage (either direct or consequential) or for any loss of time or inconvenience whatsoever and howsoever caused which may arise from such cancellation (including but not limited to visa, passport and vaccination charges, or departure, gear purchases, airport and airline taxes).

Travelex Travels and Tours L.L.C reserves the right at any time to alter any route or other arrangements; offer substitutes; or to completely cancel the whole or any portion of a tour, should conditions or circumstances necessitate or require.

 

The right is also reserved to decline the acceptance of any person as a member of a tour should the presence of that person be prejudicial to the good conduct of the tour, or be contrary to the prevailing laws of the country visited. Should this happen, Travelex Travels and Tours L.L.C. will refund the person any monies paid without interest, less the amount for services already utilized and shall be under no further liability to the Client

 

TRAVEL DOCUMENTS & VISA REQUIREMENTS

All passports and visas must be valid for at least six (6) months from the date of entry into the country destination. The Client shall be responsible for obtaining the necessary visas required for the tour.

Travelex Travels and Tours L.L.C. and its agents will not be liable to refund to the Client the whole or any part of the tour price or the price of the return air ticket or any security charges imposed by Immigration in the event that the Client is refused entry into any country of destination for any reason whatsoever.

 

INSURANCE & HEALTH REQUIREMENTS

Travel insurance is strongly recommended; to cover against accident, sickness, loss of baggage, unexpected alterations to travel arrangements, cancellation, Act of God, infectious diseases, epidemics, terrorism, acts of governments etc.


In order to enjoy the tour, passengers must generally be in good health. Therefore, it is vital that participants with medical problems make them known to us well before departure. Medical and evacuation expenses are the personal responsibility of the Client. Travelex Travels and Tours L.L.C. reserves the right to disqualify a tour participant at any time if, in its sole discretion, a tour participant is not deemed to be medically fit for travel And it does not assume any liability regarding provision of medical care.

 

RESPONSIBILITY & LIABILITY

Travelex Travels and Tours L.L.C., as agents or operators makes arrangements for hotel, transport and conveyance by whatever means and for all other related travel services. Travelex Travels and Tours L.L.C. shall not be held responsible for potential risks and hazards associated with travel to destinations included in this tour where injury delay or unanticipated events may occur. Because Travelex Travels and Tours L.L.C. acts only as the agent, outfitter or operator for the owners contractors, and suppliers providing means of transportation and/or all other related travel services, it assumes no responsibility, no matter how caused, for injury, loss or damage to person or property in connection with any service resulting directly, indirectly or for any consequential loss or damage or for any loss whatsoever and howsoever caused even if that loss or damage was foreseeable by from: acts of God, detention, annoyance, delays or for expenses arising from quarantine, infectious diseases, epidemics war or threat of war, riots, civil commotion, terrorist activities, hostilities between nations acts of governments industrial and labour disputes, boycotts, lockouts, natural and nuclear disasters, fire and flood, adverse weather conditions, technical problems with transportation, closure or congestion of airports, alterations or cancellations of schedules by carrier, government restrictions or regulations, and discrepancies or charges in transit or hotel services or any other event beyond our reasonable control. In the event that Travelex Travels and Tours L.L.C. is liable for any loss, damage or claim, its liability shall not exceed the total received amount under it of the tour price received by it under this Agreement.

 

PASSENGER’S RESPONSIBILITY & LIABILITY

Client confirms that he has read and fully understood the legal effect of Booking Terms and Conditions before booking submission.The Client may now and in the future have against, and release from all liability and agree not to sue Travelex Travels and Tours L.L.C. and its officers, employees, guides, agents or representatives (collectively its staff) for any personal injury, death, property damage, or loss sustained by the Client as a result of the Client’s participation in the tour with Travelex Travels and Tours L.L.C.. The Client is aware that some unforeseen circumstances might occur during the tour that posseses certain dangers and risks, some of which may include: physical exertion for which the Client is not prepared; weather extreme subject to sudden and unexpected change; remoteness from normal medical services; evacuation difficulties if disabled. the Client accepts all the inherent risks for the proposed tour and the possibility of personal injury, death and property damage or loss resulting from it.

 

The Client shall indemnify and hold Travelex Travels and Tours L.L.C., its associates, business partners or employees harmless at all times against all actions, proceedings, costs, claims, expenses (including legal costs on a fully indemnity basis), losses (whether direct, indirect or consequential) and damages (whether in tort, contract or otherwise) whatsoever which Travelex Travels and Tours L.L.C. may sustain, incur, suffer or paying arising out of, in connection with or pursuant to, these terms and conditions or to the use of the travel & tour services by the Client or any act or omission of the Client thereof, in particular in relation to any breach and / or non-compliance by the Client of the terms and conditions herein. This indemnity shall be separate and independent obligation from any other obligation owing to Travelex Travels and Tours L.L.C.. The Client further agrees that if the Client shall suffer injury or illness, Travelex Travels and Tours L.L.C. can, at the Client’s cost, arrange medical treatment and emergency evacuation service, as Travelex Travels and Tours L.L.C. deems essential for the Client’s safety.
